Wills and Probate Attorney for Estate Planning and Business Creation
Walsh Law provides a wide variety of services relating to probate law, including will drafting,
power of attorney, estate administration, advance directives and business organization. About half of all property passes through probate. This means the property is either passed under a decedent’s will or through intestacy (no will). The other half is considered non-probate property, and passes outside of probate under an instrument other than a will.
Possibly the most important reason to consider a Last Will & Testament is to determine who
gains custody of a minor child in the event both parents are deceased. The death of both parents can be traumatic enough, without a custody battle between surviving relatives. A carefully drafted Last Will & Testament can resolve these issues, with the hope they never arise, but with the comfort of knowing the children are cared for in a worst case scenario.
Another important area of practice is in powers of attorney, advance directives (living will) and
health care proxies, which enable a person to make difficult medical decisions, such as whether to remove life support, in advance.
Our office also provides services to those wanting to start a business or dissolve an existing one through our corporate attorneys The Walsh Law team includes attorneys knowledgeable in corporate creation as well as the formation of limited liability companies (LLCs), buy-sell agreements, and asset transfer.
The term “Uncontested Divorce” means that the parties fully and completely agree on all terms of the divorce. There will be no trial if the appropriate paperwork is properly filed. Uncontested divorces cost less than contested divorces. Only one attorney is necessary to file an uncontested divorce. Walsh Law can assist you in this divorce negotiation.

Child Custody Attorney
Primary Physical Custody and Sole Custody
In the past in Alabama, there was a marital presumption that children of a tender age were better off with their mother. This is no longer the law. Custody is based on what’s in the child’s best interest. So in the large majority of divorces in Alabama, one party is granted primary physical custody of all of the parties minor children. This does NOT mean that this parent gets to make all of the decisions related to their upbringing. Primary physical custody is not the same as Sole
Custody. Sole Custody is where one parent has the sole authority to act on behalf of the child without consulting the other parent. Sole Custody is disfavored in Alabama, unless sole custody can be shown to be in the
children’s best interest.
Most divorce decrees in Alabama grant the parties joint legal custody with one parent having primary physical custody. This means that the children primarily live with one parent, but both parents have equal authority when it comes to decisions involving the children. However, in reality, the custodial parent is the chief decision maker. Nonetheless, the law also provides that both parents should have the same rights and
responsibilities when it comes to making important decisions in their children’s lives.
